Overtime Compensation for Workers in Kenya

For the last 2 or so months, i have been been working overtime hours quite consistently, but I'm not quite sure about the overtime pay rates in Kenya. Please someone guide me on the legal provisions and safeguards around overtime pay?

Overtime is typically defined as work performed beyond the regular working hours of an employee. In Kenya, the standard working hours for most employees are 8 hours a day and 40 hours a week. Overtime compensation for workers in Kenya is governed by the Kenyan labor laws, which primarily fall under the Employment Act, 2007.

The Kenyan Employment Act stipulates the normal working hours as 45 hours per week. In instances where an employee works beyond this, they are entitled to compensation for overtime. The overtime rate should be one and one-half times the normal hourly rate on weekdays and twice the normal hourly rate on weekends and public holidays. Ensure to keep a log of your overtime hours and discuss this with your company's human resource in charge.

Calculating overtime for workers in Kenya is essential for both employers and employees to ensure fair compensation for extra hours worked. The Kenyan labour laws provide for guidelines for calculating overtime pay. Employees who work beyond their regular working hours or on public holidays are eligible for overtime. Regular working hours in Kenya are typically 8 hours per day and a maximum of 48 hours per week. Anytime worked beyond these hours is considered overtime. To calculate overtime hours, subtract the regular working hours from total hours worked. Once you've determined the overtime hours, calculate the overtime pay by multiplying the overtime hours by the overtime rate. Working on public holiday is usually entitled to double their regular hourly wage. Both the employer and employee should maintain their records of hours worked, especially overtime and should be included in an employee's regular paycheck for the corresponding pay period. If disputes or concerns regarding overtime pay arise, seek legal advice.
