What are the differences between freehold and leasehold land ownership in Kenya?


I am planning to invest in property in Mombasa. I have come across terms freehold and leasehold. What are the differences between freehold and leasehold land ownership in Kenya?

When a land is owned in freehold, it means that the owner can sell or transfer ownership without restrictions. Leasehold ownership is a limited type of ownership. Rights to use the land are granted on specified period of time, usually 99 or 999 years after which it is returned to the original land owner or landlord.

On the other hand, leasehold grants a person ownership of land for specified period. Once this period elapses, the ownership of the land reverts back to the grantor.
The duration for leasehold titles in Kenya is a maximum term of 999 years for agricultural land and 99 years for urban plots.
