In Kenya, digital contracts are provided for under the Kenya Information and Communication Act (KICA). The act states that any contract formed between parties using electronic means is valid and enforceable. Some of the digital contracts are web-form contracts which are contracts filled out online, browse-wrap contracts, click-wrap contracts among others. Digital contracts are safe in the sense that:
-They provide a centralised access using the electronic devices.
- They have a customized control where the devices maintain high security and sensitivity, and this ensures that contracts do not end up in the wrong hands.
- Digital contracts enable tracking of the status of your contract and engagement with the counterparty at any time using the electronic devices.
-They save time, paper and even storage because they are paperless, and this reduces work overload.
