Unfair dismissal from work is the termination of an employment by the employer without following the right process or in bad faith. The Kenyan labour laws set out the due process in which an employee should be terminated failure to which an employee should:
i) First, review their employment contract and the company policies before taking any legal action.
If the first option doesn't work.
ii) Within three months of the alleged unlawful termination file a complaint at the labour offices OR
iii) File a memorandum of claim at a court tribunal, that is, the Employment and Labour related Court with the assistance of an advocate within a year of the alleged unfair dismissal
The possible outcomes in a case where the court makes a ruling in favour of the employee are Compensation, reinstatement or re- employment.
