Section 101 of The Children Act CAP 141: Custody, care and control

    

(1) Where a person who does not have the legal custody of a child is entrustedwith the care and control of the child, the person is under a duty to safeguard the interests and welfare of the child.
(2) Where a person, not having legal custody of a child, has actual custody ofthe child, the person shall be deemed to be charged with the care of the child, and shall take all reasonable steps to safeguard the interests and welfare of the child.
(3) In this Act, unless the context otherwise requires, reference to the person under whom a child has his home refers to the person who has care and control of that child and does not include a hospital, hostel or boarding school, at which the child is temporarily accommodated.
