Section 99 of The Companies Act No. 17 of 2015: Register of members: offences in connection with request for or disclosure of information

    

(1) A person who makes a request under section 96 that contains a statement
that the person knows, or has reason to suspect, is false or misleading in a material
respect commits an offence.
(2) A person who has possession of information obtained by exercise of either
of the rights conferred by section 96—
(a) to do anything that results in the information being disclosed to
another person; or
(b) to fail to do anything with the result that the information is disclosed
to another person,
knowing, or having reason to suspect, that person may use the information for
a purpose that is not a proper purpose.
(3) A person found guilty of an offence under this section is on conviction liable
to a fine not exceeding five hundred thousand shillings or imprisonment for a term
not exceeding two years, or to both.
