Section 814 of The Companies Act No. 17 of 2015: Power to bring civil proceedings on company’s behalf

    

(1) If, from a report made under section 797 or 809, the Attorney Generalconsiders that proceedings ought, in the public interest, to be brought by a body corporate named in the report—
(a) for the recovery of damages in respect of any fraud, misfeasance or other misconduct in connection with the promotion, formation or management of the body; or
(b) for the recovery of any property of the body that has been misapplied or wrongfully retained, the Attorney General may bring proceedings for that purpose in the name of the body.
(2) The Attorney General shall indemnify the body corporate against any costs or expenses incurred by it in or in connection with any proceedings brought under subsection (1).
