Section 562 of Insolvency Act CAP 53: Company's business documents to state that company's affairs are under administration

    

(1) While a company is under administration, the administrator shall ensure that all business documents issued by or on behalf of the company or the administrator, and all the company's websites, state—
(a) the name of the administrator; and
(b) that the affairs and property of the company are being managed by the administrator.
(2) An administrator who, without reasonable excuse, fails to comply with subsection (1) commits an offence and on conviction is liable to a fine not exceeding five hundred thousand shillings.
(3) If, while under administration, a company sends or publishes a business document that does not state—
(a) the name of the administrator; and
(b) that the affairs and property of the company are being managed by the administrator, the company, and each officer of the company who is in default, commit an offence and on conviction are each liable to a fine not exceeding five hundred thousand shillings.
(4) In this section, "business document" means—
(a) an invoice;
(b) an order for goods or services;
(c) a business letter; or
(d) an order form, whether in hard copy, electronic or any other form.
