Section 29 of Partnerships Act 16 of 2012: Power to expel partner

    

(1) A majority of partners in a partnership may expel a partner if— (a) an order is made against the partner under section 44; or
(b) the whole or a part of the partner’s shares in the partnership is subject to an attachment in execution in respect of a debt which is not a partnership debt.
(2) The partners in a partnership may only expel a partner under subsection (1) if they issue the partner with a notice of not less than three months of their intention to do so.
(3) An expulsion notice under subsection (2) shall not have effect if before its expiration—
(a) the order referred to in section 44 is revoked; or
(b) the attachment referred to in subsection (1)(b) is recalled or withdrawn or otherwise ceases to have effect.
